The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process. In the event of a dispute regarding any entry, the entry will be deemed made by the authorized account holder of the email address submitted at the time of entry (i.e., the person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address). Sponsor reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes should a virus, bug, or other cause beyond the control of the Sponsor corrupt the administration, security, or proper operation of the Sweepstakes. In the event of termination of the Sweepstakes, a notice will be posted online and a random drawing to award the prizes will be conducted from among all eligible entries received prior to the time of termination. Sponsor reserves the right to modify the Sweepstakes or disqualify entrant if fraud, misconduct, or technical failures destroy the integrity of the Sweepstakes as determined by Sponsor, in its sole discretion. All material submitted becomes the sole property of Sponsor and will not be returned. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes, or in the announcement of the prizes. Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user's Internet Service Provider and/or e-mail client or for insufficient space in user's e-mail account to receive e-mail.
- WINNER SELECTION: Winners will be selected in a random drawing from all eligible entries received during the promotional period from all methods of entry. Drawing will be conducted by an independent judging organization on or around January 15, 2009. By entering the Sweepstakes, entrants agree to be bound by the Official rules and the decisions of the Sponsor and the Independent Judging Organization. Winners will be notified by mail or telephone. Odds of winning are based upon the number of eligible entries received.
- PRIZES: GRAND PRIZES: Five Hundred (500) Limited Edition Cookie Cutter Sets, 2002 - 2007 (9 per set), Average Retail Value $50.00. FIRST PRIZES: Five Hundred (500) Land O'Lakes American Heritage Cookbooks, Average Retail Value $15.95. SECOND PRIZES: One Hundred and Twenty-Five (125) Baking Sets consisting of 1 cookie sheet and a spatula, Average Retail Value $7.50. Sweepstakes total prize value $33,912.50. Prizes cannot be exchanged or transferred. No cash equivalent. Sponsor reserves the right to substitute a prize of equal or greater value at its sole discretion.
- ELIGIBILITY: Participation in the Sweepstakes is open only to legal U.S. residents age 18 or older who submit correctly completed entries. Void where taxed, restricted or prohibited by law and in Puerto Rico or other U.S. territories and possessions. The following categories of persons are not eligible to participate or win: persons who after January 1, 2008 were or are employees, officers, representatives and agents of Sponsor, their affiliates and advertising, promotional and judging agencies, individuals engaged in the development, production or distribution of materials or the implementation of this Sweepstakes, and persons in the immediate family or living in the same household of any person in any of the above mentioned categories.
- CONDITIONS: : Provisional prize winners will be notified via USPS or telephone and may be asked to sign and return an Affidavit of Eligibility and Release within 10 days of notification in a supplied prepaid return envelope. In the event of non-compliance, or if the prize is returned as unclaimed or undeliverable, the prize will be forfeited and may be awarded to an alternate winner. All federal, state and local laws apply. All federal, state and local taxes on prize and all other expenses not specifically set forth herein are the sole responsibility of the winner(s). Entry and acceptance of prize constitutes permission to use winner's name, address (city and state), likeness, photograph and any statements regarding the promotion for advertising and promotional purposes in any media, without additional compensation except where prohibited by law. No transfer of prize, prize substitution or cash equivalent for prize except at sponsors' sole discretion. Entry forms submitted become the property of the sponsor and will not be returned. By participating, entrants agree to abide by these rules and release Land O'Lakes, its parents, subsidiaries, affiliates, agencies and employees from any and all liability, loss, damage, cost or expense whatsoever including without limitation property damage, personal injury and/or death which may arise directly or indirectly from acceptance or use of prize or traveling to any prize related activity. Entrants agree to abide by the Privacy Statement and online Legal Policy of www.landolakes.com. Sponsor shall have the right to post the winners' names, places of residence, pictures, and other information obtained on one or more Land O'Lakes affiliated websites without additional compensation.
- DISPUTE RESOLUTION. Each participant agrees that: (a) any and all disputes, claims, and causes of action arising out of or in connection with this promotion, or any prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Minnesota; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this promotion, but in no event shall such damages include attorneys' fees; and (c) under no circumstances will a participant be permitted to obtain awards for, and each participant hereby waives all rights to punitive, incidental, or consequential damages, or any other damages other than actual out-of-pocket expenses. Participants shall not claim or receive any damages subject to being multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and the Sponsor in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Minnesota or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Minnesota.
